The short answer

Yes, an NRI can buy residential and commercial property in Jaipur without any approval from the Reserve Bank of India, as long as the money comes through normal Indian banking channels. The hard part is rarely the rules. It is checking a property properly when you are thousands of kilometres away. That is the gap we fill: we see the property, check the papers, and you decide with full information.

You approve every shortlist, every offer and every rupee. We do the legwork in Jaipur.

What NRIs can and cannot buy

  • Allowed: apartments, independent houses, villas, builder floors, residential plots, and commercial property such as shops, showrooms and offices. There is no limit on the number of residential or commercial properties you can own.
  • Not allowed: agricultural land, plantation property and farmhouses. These can only come to an NRI by inheritance, or in limited cases as a gift from a resident relative.
  • Joint ownership: you can buy jointly with a resident family member. Check how the payment is split, as it affects repatriation later.

If a listing is marketed as a “farmhouse plot” or sits on land that has not been converted from agricultural use, it is not suitable for an NRI purchase. Land use and conversion are among the first things we check.

Paying for the property

  • NRE account: holds money earned abroad. Payments from here keep the purchase repatriable later.
  • NRO account: holds income earned in India, such as rent. It can be used for a purchase; repatriation from NRO is capped at USD 1 million per financial year, after taxes.
  • Inward remittance: money sent directly from abroad through a bank is also accepted.
  • Home loans: most Indian banks lend to NRIs, typically repaid from an NRE or NRO account.

Cash, foreign currency notes and informal transfers cannot be used. Keep every bank record from the purchase; you will need them when you sell.

How a purchase works with us

  1. Brief call. Budget, preferred localities, configuration, timeline, and whether the property is for living, renting or investment.
  2. Shortlist and video walkthroughs. We visit each option and send live or recorded walkthroughs, with honest notes on the building, the street and the neighbourhood.
  3. Document check. Title chain, RERA registration for new projects, approvals, encumbrance status, dues and land use, reviewed before you commit.
  4. Negotiation and booking. We negotiate on your behalf within the limits you set.
  5. Agreement and registry. Coordination of the sale deed, stamp duty and registration at the sub-registrar office, in person on your visit or through a power of attorney.
  6. After purchase. Mutation, utility transfers, and if you wish, tenant search and ongoing property management.

Selling, tax and repatriation

When an NRI sells property in India, the buyer must deduct tax at source on the sale price before paying you. For property held more than 24 months, long-term capital gains for NRIs are taxed at 12.5% without indexation, plus surcharge and cess. Because the deduction applies to the sale value rather than your actual gain, many sellers apply in advance for a lower deduction certificate from the Income Tax Department.

Sale proceeds can be sent abroad within the limits set by FEMA, with a chartered accountant’s certificate. Tax rules and section numbers change, so always confirm the current position with a CA before you sign. We work alongside your CA and lawyer; we do not replace them.

Power of attorney and documents

You do not have to fly in for every step. A specific power of attorney, limited to one property and one transaction, lets a trusted person sign on your behalf. If executed abroad, it is attested at the Indian embassy or consulate and stamped in Rajasthan after it arrives.

  • Passport, with OCI card where applicable
  • PAN card
  • Overseas address proof and an Indian address for correspondence
  • NRE or NRO bank account details
  • Passport-size photographs for the registry

How Lali Properties helps

We have worked from C Scheme since 2018 and know Jaipur’s localities street by street, from established addresses such as C Scheme and Malviya Nagar to growth corridors such as Jagatpura and Vaishali Nagar. As an authorised channel partner for several Jaipur projects, we can also arrange direct access to developers for new launches. Whether you are buying a home for your parents, an apartment to let, or a commercial unit for income, one team handles it end to end.

Before you commit: checklist

  • Property type is permitted for NRIs (not agricultural land or a farmhouse)
  • Title chain and encumbrance status verified
  • RERA registration confirmed for under-construction projects
  • Payment route planned: NRE, NRO or inward remittance
  • Specific power of attorney drafted, if you will not attend the registry
  • Stamp duty and registration costs budgeted (see our stamp duty guide)
  • Plan for renting or managing the property after purchase

Questions NRIs ask us

Do I need RBI permission to buy a flat in Jaipur?

No. NRIs and OCI cardholders can buy residential and commercial property without RBI approval, provided payment is made through Indian banking channels.

Can I buy a farmhouse or agricultural land?

No. NRIs cannot buy agricultural land, plantation property or farmhouses. They can only be acquired by inheritance, or in limited cases as a gift from a resident relative.

Do I have to be in Jaipur to complete the purchase?

Not necessarily. Many of our NRI clients visit once, or not at all, and complete the registry through a specific power of attorney given to a family member.

Can you rent out and manage the property after I buy?

Yes. We find and screen tenants, handle agreements and police verification, follow up on rent and coordinate repairs, with your approval on anything significant.

Can you help me sell inherited property in Jaipur?

Yes. We help with valuation, finding buyers and coordinating documents, and work with your CA on tax and repatriation.
